Eterd. Terms of Service

These Terms of Service (hereinafter referred to as the "Terms") define the conditions for using the website, music distribution, product sales, and all other services (hereinafter referred to as the "Service") provided by Eterd. (hereinafter referred to as the "Label"). Users (hereinafter referred to as "Users") shall use the Service in accordance with these Terms.

Article 1 (Application)

These Terms shall apply to all relationships between the User and the Label concerning the use of the Service. In addition to these Terms, the Label may establish individual provisions, guidelines, or precautions (hereinafter referred to as "Individual Provisions") regarding the Service. These shall constitute part of these Terms. In the event of any conflict between these Terms and Individual Provisions, the Individual Provisions shall prevail.

Article 2 (Intellectual Property Rights)

Copyrights, trademarks, and all other intellectual property rights related to all content provided through the Service (music, audio, lyrics, images, videos, text, designs, logos, programs, etc.) belong to the Label or the right holders with legitimate authority. Users may not use the content on the Service (including reproduction, reprinting, modification, adaptation, public transmission, distribution, sales, etc.) beyond the scope of private use permitted by copyright law without the Label's prior written consent.

Article 3 (Prohibited Matters)

Users shall not engage in the following acts when using the Service: - Acts that violate laws or public order and morals - Acts that infringe upon the intellectual property rights, portrait rights, privacy, honor, or other rights or interests of the Label, other users, or third parties - Acts that destroy or interfere with the functions of the Label's servers or networks - Acts of using information obtained through the Service for commercial purposes (except when approved by the Label) - Acts that may interfere with the Label's operation of the Service - Acts of unauthorized access or attempting such access - Any other acts deemed inappropriate by the Label

Article 4 (Suspension of Service)

The Label may stop or interrupt the provision of all or part of the Service without prior notice if it determines that any of the following reasons exist: 1. When performing maintenance or updates on the computer system related to the Service 2. When the provision of the Service becomes difficult due to force majeure such as earthquakes, lightning, fire, power outages, or natural disasters 3. Other cases where the Label determines that providing the Service is difficult The Label shall not be liable for any disadvantage or damage suffered by Users or third parties due to the suspension or interruption of the Service.

Article 5 (Disclaimer of Warranties and Limitation of Liability)

The Label does not guarantee that the Service is free from factual or legal flaws (including defects related to safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, security, errors or bugs, or infringement of rights). The Label shall not be liable for any damages incurred by Users arising from the Service. However, if the contract between the Label and the User (including these Terms) constitutes a consumer contract as defined by the Consumer Contract Act, this disclaimer of liability shall not apply. Even in the cases specified above, the Label shall not be liable for damages resulting from special circumstances (including cases where the Label or User foresaw or could have foreseen the occurrence of damage) among damages incurred by Users due to default or tort caused by the Label's negligence (excluding gross negligence).

Article 6 (Changes to Service and Terms)

The Label may change the content of the Service or discontinue its provision without notice to Users and shall not be liable for any damages incurred by Users as a result. The Label reserves the right to change these Terms at any time without prior notice if it deems it necessary. The revised Terms shall become effective from the time they are posted on the location designated by the Label (such as this website).

Article 7 (Governing Law and Jurisdiction)

The interpretation of these Terms shall be governed by the laws of Japan. In the event of any dispute regarding the Service, the court having jurisdiction over the location of the Label shall be the exclusive agreed jurisdictional court. Established: April 2026
